You're right. That's the reason I observed the difference.

It is working with gnuplot 4.0. And I found (a reason for) the
failure. Or let's say, an indication.
TMPDIR=/tmp octave < xx.m : works,
TMPDIR=/var/tmp octave < xx.m : does NOT work!!!!!!!!!
with the appended xx.m (the same script that you already
got). (At least in my system.)
You've probably a good overview in order to identify the cause
why octave and gnuplot are using $TMPDIR, /tmp, or whatever in an
irreproducible manner, depending on the input data (number of
plots, legend, ...), and not communicating in detail with each
other.
For now I'm happy, but the setting of $TMPDIR is a workaround
only.
